The only form of justice permitted by American Law for individuals who have been wronged by the negligent, reckless or intentional acts of another is monetary compensation (the criminal law provides justice for society as a whole and not for individuals, as the prosecutor in a criminal case represents the state not the victim).

Accepting monetary compensation in exchange for physical and mental injuries is really an act of forgiveness.  This is because the law limits compensation to what the wrongdoer can reasonably afford to pay without suffering a hardship themselves.  By providing, at least some relief to the injured, monetary compensation actually provides a form of closure for both the injured and the injuring party. 

Before the injured can actually move on, however, they need to know that the result is fair.  This really means fair in comparison to what other injured people in the same or similar circumstances are getting.  This requires not only knowledge of what types of claims are legally permissible and the many different types of traumatically caused injuries one can suffer, but also the value of all these many different types of claims.

Despite propaganda to the contrary, no claims are settled by insurance companies, other large corporations or the state, if they believe they can win the case.  They simply have too much financial power to be intimidated by any single law firm.   That is why it is essential to be properly prepared in advance by knowing the law, what claims are permissible and how to effectively prove the full extent of the injured person’s injuries.  

Often times, great financial power results in an arrogant refusal to pay valid claims.  On those rare occasions when we could not successfully settle our client’s claim and we were forced to go to trial, our office has a record of success in more than 90% of those cases over the last 20 years!  Although less than 1% of the thousands of claims we have handled actually went to trial, we have prepared hundreds of cases for trial that settled due to thorough preparation.   We have also settled hundreds of difficult cases through arbitration and mediation without trial.
